The Court is non-partisan with solid conservative leanings.

Last year, the Court dismissed an appeal from the only woman on death row. Robin Row was convicted in 1993 of aggravated arson and 3 counts murder, for starting the apartment fire that killed her husband and two children while they slept.
Also in 2008, the Court rejected a death sentence appeal from a mentally retarded man convicted of the 1986 beating death of a woman and her nephew. The U.S. Supreme Court ruled in 2002 that it was unconstitutional to execute someone who is mentally ill. One standard of mental illness in Idaho is an IQ under 70. Gerald Pizzuto Jr. has an IQ of 72.
