Kentucky Court is non-partisan with a conservative majority.
Terms are 8 years and elections are staggered. The next election cycle is 2010. In January 2009 the Court ruled that property owners are not legally required to disclose the presence of asbestos in buildings to independent contractors or laborers performing renovations to said building.
Earlier, in 2008, the Court issued an opinion regarding a custody appeal by a man who fathered a child with a married woman. The court determined that marriage, not DNA, determines parenthood, with Justice Cunningham giving the majority decision by claiming that married couples have greater rights than the claims of “interloper adulterers.”
